Personal Data Protection Notice

In compliance with the Personal Data Protection Act 2010 (“PDPA 2010”) and its regulations, this Personal Data Notice (“this Notice”) describes how Messrs Nik Hussain & Partners (“the Firm”) uses your Personal Data (defined below) and will inform you of your rights with regards to your Personal Data that has been and/or will be collected and processed by us.

Pursuant to section 7(3) of the PDPA 2010, this Notice is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.
By engaging the Firm to provide legal services to you or by communicating with the Firm or by using the Firm’s website (http://www.nhp.com.my) (“our Website”), you consent to the processing of your Personal Data by the Firm and all persons involved in the provision of services by the Firm, as described in this Notice.

The Firm shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the Website. By continuing to communicate with the Firm or by continuing to use the Firm’s services following the modifications, updates or amendments to this Notice, this shall signify your acceptance of such modifications, updates or amendments.

Collection and Sources of Personal Data

  1. Personal Data” means information about you which you have provided to the Firm, such as your name, address, telephone number, NRIC number, passport number, email address, your personal preferences, particulars of your spouse or family members and bank account information and any information which may identify you, your spouse or family members that has been or may be collected, stored, used and processed by the Firm from time to time.
  2. In addition to the Personal Data you provide to the Firm directly (i.e. during your communications with the Firm and/or when you engage the Firm to provide services), the Firm may also collect your Personal Data from a variety of sources, including but not limited to, at any events organised or sponsored by the Firm, from the cookies used on the Website and/or obtained independently by us or given to us from other lawful sources.

Impact of Non-Provision of Personal Data

  1. The provision of your Personal Data is voluntary. However, if you do not provide your Personal Data, the Firm may not be able to communicate with you, provide you the services you require, or process your Personal Data for the purpose relating to potential internship, pupillage or employment with the Firm.

Purposes of Collection and Processing

  1. The Firm may use and process your Personal Data for the purposes relating to the services you have requested and for the business activities of the Firm which shall include, but is not limited to the following:-
  • to communicate with you;
  • to respond to questions and comments from you;
  • to assess the suitability of your application for internship, pupillage or employment;
  • for internal administrative purposes;
  • to provide information to regulatory and governmental authorities in order to comply with statutory and government requirements;
  • for the Firm to comply with its obligations under law, including compliance with laws relating to evidence;
 

and you agree and consent to the Firm using and processing your Personal Data in the manner as identified in this Notice.

Other Purposes

  1. The Firm may also use and process your Personal Data for other purposes such as:-
  • for preparing/generating and or submitting Tax Invoices and/or Billing of our Legal Services provided by the Firm to you;
  1. If you do not consent to the Firm processing your Personal Data for the purposes listed in paragraph 5, please notify the Firm using the contact details stated in paragraph 10 below.

Transfer of Personal Data

  1. As the Firm’s information technology storage facilities and servers may be located in other jurisdictions, your Personal Data may be transferred to, stored, used and processed in a jurisdiction other than Malaysia. Further, your Personal Data may be transferred out of Malaysia for the purposes as described in paragraph 5(3) where such ranking legal publications and journals and/or potential clients are located outside of Malaysia. You understand and consent to the transfer of your Personal Data out of Malaysia as described herein.

Disclosure to Third Parties

  1. The Firm may engage other companies, service providers or individuals to perform functions on the Firm’s behalf, and consequently may provide access or disclose your Personal Data to the Third Parties such as, but not limited to, those listed below:-
  • information technology service providers;
  • accounting software service provider and their personnel;
  • data entry service providers;
  • storage facility providers;
  • banks and financial institutions;
  • insurance providers;
  • any professional advisors and external auditors;
  • regulatory and governmental authorities in order to comply with statutory and government requirements.
 

Access & Correction Requests and Inquiries

  1. Subject to any exceptions under applicable laws, you may at any time hereafter request:-
  • for access to your Personal Data;
  • for correction or rectification of your Personal Data;
  • to limit the processing of your Personal Data; or
  • to seek further information from the Firm regarding the processing of your Personal Data.

  1. In respect of your right to access and/or correct your Personal Data, the Firm has the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under law, such as where the expense of providing access to you is disproportionate to the risks to your privacy.
